この利用規約（以下，「本利用規約」といいます。）は，川越市（以下，「市」といいます。）が観光振興を目的として開発したWEB ARサービス（以下，「本サービス」といいます。）の利用に関する条件を本サービスの利用者（以下，「利用者」といいます。）と市の間で定めるものです。

第１条（定義）

本利用規約は，本サービスを利用するために必要な事項を定めるものです。本利用規約に同意した方に限り，本サービスを利用できるものとし，利用を開始した時点で，本利用規約に同意したものとみなします。

第２条（プライバシーポリシー）

市は，本サービスにおける利用者の個人情報または個人情報に該当しうる情報を個人情報の保護に関する法律に従って，適切に取り扱います。

第３条（利用環境）

本サービスの利用は無料ですが，利用に伴う通信費用その他一切の費用については，利用者の負担となります。

第４条（禁止事項）

利用者は，本サービスの利用にあたり，次の各号の行為を行ってはいけません。

• (1) 市のサービス運営を妨害すること
• (2) 本サービスを商業営利目的のために利用すること
• (3) 法令，公序良俗または本利用規約等に違反する行為
• (4) 本サービスの著作権，商標権，特許権等の知的財産権，名誉権，プライバシー権その他法令上または契約上の権利を侵害する行為
• (5)リバースエンジニアリング，逆アセンブルを行う行為，その他の方法でソースコードを解読する行為
• (6) その他市が不適当と判断する行為

第５条（利用者の責任）

１. 利用者は，利用者の責任において本サービスを利用するものとし，本サービスにおいて行った一切の行為およびその結果について一切の責任を負うものとします。

２. 市は，利用者が以下のいずれかに該当する場合または該当するおそれがある場合，あらかじめ利用者に通知することなく，本サービスの全部または一部の利用の停止その他市が必要かつ適切と合理的に判断する措置を講じることができます。

• (1) 適用のある法令または本規約もしくは個別利用条件に違反した場合
• (2) 反社会的勢力の構成員またはその関係者である場合
• (3) 風説の流布，偽計，威力その他の不正な手段を用いて市の信用を毀損する場合
• (4) (1)から(3)までに定めるもののほか，利用者との信頼関係が失われた場合その他利用者への本サービスの提供が適切でないと市が合理的に判断した場合

3. 利用者は，本サービスを利用したことに起因して，市が直接的または間接的に（市が第三者から請求を受ける場合も含みます。）何らかの損害（弁護士費用の負担を含みます。）を被った場合，市の請求にしたがって直ちにこれを賠償しなければなりません。

第６条（免責）

本サービスの動作及び本サービスで提供する情報の正確性，最新性，有用性等については万全を期していますが，完全性を保証するものではありません。本サービスの利用に伴い利用者が損害を被った場合または第三者に損害を与えた場合においても，市は一切の責任を負わないものとします。

第７条（著作権の取り扱い）

本サービスに関する知的財産権及び権利は市または正当な権利者に帰属します。また，本サービスで提供する情報に関する知的財産権及び権利は各情報提供者に帰属します。

第８条（二次利用）

本サービスが提供する情報については，有償無償や加工の有無に関わらず，許可なく頒布，転載，出版，放送する行為等は禁止します。

第９条（サービスの中断，変更，廃止）

市は，本サービスに関する全部または一部を事前の通知なく中断，変更または廃止することができるものとします。

第１０条（利用規約の変更）

市は，事前の通知なく本利用規約を変更することがあります。利用規約の変更を行った場合は，市が適切と判断する方法で利用者に通知または公表するとともに，重要なものについてはバージョンアップ後の初回起動時に通知し，改めて同意を取得します。変更後の本規約は，効力発生日から効力を生じるものとします。

第１１条（準拠法）

本利用規約は，日本国の法令に準拠し，日本国の法令に従って解釈されるものとします。

本サービスに起因または関連して利用者と市との間に生じた紛争については、さいたま地方裁判所川越支部又は川越簡易裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions for the use of the WEB AR service (hereinafter referred to as "the Service") developed by Kawagoe City (hereinafter referred to as "the City") for the purpose of promoting tourism, between the users of the Service (hereinafter referred to as "Users") and the City.

Article 1 (Definitions)

These Terms define the necessary matters for using the Service. Only those who agree to these Terms may use the Service, and it is deemed that they have agreed to these Terms at the time they start using the Service.

Article 2 (Privacy Policy)

The City will appropriately handle the personal information of Users or information that may be considered personal information in accordance with the Act on the Protection of Personal Information.

Article 3 (Usage Environment)

The use of the Service is free of charge; however, any communication costs and other expenses incurred in connection with the use of the Service shall be borne by the Users.

Article 4 (Prohibited Acts)

Users shall not engage in any of the following acts when using the Service:

• (1) Interfering with the operation of the City's services
• (2) Using the Service for commercial profit
• (3) Acts that violate laws, public order and morals, or these Terms
• (4) Infringing on the intellectual property rights, honor rights, privacy rights, or other legal or contractual rights of the City or others
• (5) Engaging in reverse engineering, disassembly, or any other method to decipher the source code
• (6) Any other acts deemed inappropriate by the City

Article 5 (User Responsibility)

1. Users shall use the Service at their own responsibility and shall bear all responsibility for any acts and their consequences performed in the Service.

2. The City may take necessary and appropriate measures, including suspending all or part of the Service, without prior notice to Users, if Users fall under any of the following categories or are likely to do so:

• (1) Violating applicable laws, these Terms, or individual usage conditions
• (2) Being a member of or associated with anti-social forces
• (3) Damaging the City's credibility using rumors, deception, force, or other illegal means
• (4) In addition to (1) to (3), if the trust relationship with the User is lost or if the City reasonably determines that providing the Service to the User is inappropriate

3. If the City suffers any damage (including attorney fees) directly or indirectly due to the User's use of the Service, the User must immediately compensate the City upon request.

Article 6 (Disclaimer)

While the City strives for the operation of the Service and the accuracy, timeliness, usefulness of the information provided, it does not guarantee completeness. The City shall not be liable for any damages incurred by Users or damages caused to third parties as a result of using the Service.

Article 7 (Handling of Copyright)

Intellectual property rights and rights related to the Service belong to the City or legitimate rights holders. Additionally, intellectual property rights and rights related to the information provided in the Service belong to each information provider.

Article 8 (Secondary Use)

The information provided by the Service may not be distributed, reproduced, published, or broadcast without permission, regardless of whether it is for profit or non-profit or whether it is processed.Article 9 (Suspension, Change, or Abolition of Service) The City may suspend, change, or abolish all or part of the Service without prior notice.

The City may change these Terms without prior notice. If changes are made, the City will notify or announce Users in a manner deemed appropriate, and for significant changes, will notify Users at the first launch after the version upgrade and obtain consent again. The revised Terms will take effect from the date of effect.

Article 11 (Governing Law)

These Terms shall be governed by and construed in accordance with the laws of Japan.

Article 12 (Jurisdiction)

For any disputes arising from or related to the Service between Users and the City, the Saitama District Court Kawagoe Branch or the Kawagoe Summary Court shall be the exclusive court of first instance.
